About The Bikini Contest: Berrydog would like to invite our customers to submit pictures of themselves in our bikinis. We will then select the contestants and pictures that we deem suitable to appear in our contest. We will then select three winners from the group who will receive the cash and prizes described below.

The Prizes: All contestants who are selected to appear in the contest will receive a free Berrydog Bikini. After 24 submissions will select a first place, second place and third place winner. First Place will receive $250 cash and $100 gift certificate redeemable for Berrydog Gear. Second Place gets $150 cash and a $75 gift certificate redeemable for Berrydog Gear and Third place receives $75 cash and a $50 gift certificate redeemable for Berrydog Gear.

The Bikini Contest Rules:

1) Contestants must be wearing BERRYDOG BIKINIS. PLEASE DO NOT SUBMIT PICTURES IF THEY DO NOT SHOW YOU WEARING A BERRYDOG BIKINI. 

2) We ask that all submitters be at least 18 years old.

3) After 24 submissions we will then select a first place, second place and third place winner.

4) Professional & Semi-Pro models and Photographers are allowed to enter the contest.

5) Not everyone submitting pictures to us will be selected to appear in the contest. WE ASK THAT YOU PLEASE NOT SUBMIT PHOTOS IF YOU WILL GET ANGRY IF WE DO NOT SELECT YOU FOR THE CONTEST.

PLEASE DO NOT CONTACT US IF YOU ARE NOT SELECTED, AS WE DO NOT ENGAGE IN ANY DISCUSSION REGARDING OUR SELECTION PROCESS.

Picture Selection & Requirements:

1)    We suggest that you submit photos that are artistic and interesting and beach setting is preferred but not required. Pictures taken in the back yard, studio or in your apartment will be accepted but you have a better chance if pictures are taken on the beach or in a public setting.

2)    Some of the photos must show the models face.

3)    Pictures must be clear and of good quality. Do not submit grainy or poor quality photos.

4)    We will publish up to 8 photos so send us a good number of photos from which we can select.

5)    Photos must be in gif or jpeg format. Photos must be no more than 200K in size. Keep your e-mails under 3mb so we suggest that you zip your pictures prior to e-mailing them.

6)    Artistic photos are accepted as long as they are tasteful and are somehow tied in with our swimwear. Please do not submit explicit material

7)    Include a story with your submission such as where the pictures were taken and what the reaction from your husband, boyfriend or strangers were to your Berrydog Bikini. Also tell us how you feel about our bikinis. Your endorsement is highly valued.

Legal:

In consideration of Berrydog granting you the opportunity to enter our bikini contest and/or submitting Material to the Site, You hereby agree that:

• such Material is non-confidential; and
• by submitting such Material, You are deemed to have provided a valid and binding electronic signature (as permitted under the Electronic Transactions Act 1999) authorizing the assignment of all rights, title and interest in all such Material to Berrydog, its assigns and licensees, to use, reproduce, modify, adapt, create derivative works from, distribute and publicly display such Material, for any purpose whatsoever, in any media, throughout the world in perpetuity.

• You warrant and represent that:

• any Material submitted to the Site is original and will not infringe or breach any law or any person's right under any law (including any law or right relating to copyright, passing-off, defamation, contempt of court, privacy, publicity or confidence);
• any Material submitted to the Site is free from encumbrances and You have full and unfettered power to assign all rights and interest in the Material to Berrydog, free from any claim by any person;
• You own all rights, title and interest (including copyright) in any Material submitted to the Site, or have obtained all necessary consents and releases from third parties for all and any use of the Material by Berrydog in perpetuity, without any requirement for Berrydog to make any payment to You or such third parties, and can provide any written evidence of this to Berrydog on Berrydog’s request;
• You have not assigned, licensed or otherwise granted any rights in the Material or entered into any deed or agreement that would prevent or limit Berrydog's rights to use the Material;
• as to living people identifiable in the Material, if any, You have acquired written permissions and releases permitting the exclusive use of the said person's name, likeness and life story in connection with any use of the Material and You hereby assign such rights to Berrydog;
• You will enter into any formal written documentation if required by Berrydog, to formalize Your assignment of all rights in the Material to Berrydog; and

• You have not done, or permitted to be done, any act or omission by which any of the rights in the Material have been, or may in any way, be impaired or limited.
